What is the German Immigration Law?
With the German Immigration Law, which came into effect on March 1, 2020, those who want to work in Germany have been granted the right to obtain a work and residence permit if they fulfill the conditions specified in the law. According to the data of the Federal Employment Agency, there is a shortage of approximately 1 million qualified and qualified personnel in Germany. This deficit is expected to increase further in the next 5 years. For this reason, with the German Immigration Law, it aims to close the increasing shortage of qualified personnel and to fill employment areas quickly.
With the German Immigration Law, working in Germany is made easier by law, but it is subject to certain conditions. The most important of these is the concept of qualified workforce defined in the law. It is stated in the law that not everyone who wants to work in Germany will be accepted, and that vocational certificate or diploma holders can be employed. In other words, people who do not have any qualifications or certificates or are low-qualified cannot benefit from this law. Germany only allows qualified and expert persons to work. What is meant by a skilled workforce is to have a corresponding education in a profession in Germany. And they are the people who can prove this with a document such as a diploma or certificate. If you are a university graduate or a Vocational High School graduate, you are considered a qualified workforce. In addition, the certificates and trainings you receive regarding the jobs that require mastery will put you in this group. Documentation is absolutely necessary for you to be accepted as a qualified workforce specified in the law.
In accordance with the purpose of the concept of skilled labor in the German Immigration Law, two definitions are made as Qualified Workforce with Vocational Education and Qualified Workforce with Academic Education. Anyone who falls within these two definitions can start the application process. To work in Germany, it is not enough that you meet the definition of a skilled workforce. The equivalence of your diploma or documents must be obtained. In other words, the documents you have must be accepted by Germany. Professional Equivalence; Documents obtained from outside of Europe mean that you have received education in accordance with German standards and that you are professionally accepted by Germany.
What's New With Germany's Immigration Law
The German Immigration Law basically defines two main criteria and accepts the applications of those who want to work in Germany. The first of these is the vocational equivalence, as we mentioned above. Another criterion is the German language requirement. Although this criterion differs for each occupational group, you are generally expected to know a B1 level language.
Let's take a look at some of the innovations brought by the German Immigration Law;
The Concept of Qualified Workforce Has Been Introduced: The rights granted only to college graduates in the previous immigration law have also been granted to holders of vocational certificates in the new law. Qualified labor force was defined for people who have sufficient education in a valid occupational branch in Germany (vocational high school graduate, vocational certificate holder or university graduate), and those who are considered as qualified labor force are provided with the necessary facilities to work in Germany.
Abolition of the Positivlist System: In the old law, vocational high school graduates could only apply to job postings specified in a need list. There were no opportunities to work in any field other than this list. With the new law, the way for them to work in any job related to the field they received equivalency has been opened.
